Application owner, offering and linking Terms

This application is owned and operated by UNLOOP. These Terms set out the terms and conditions under which you can use our application and associated services.
Through the "MY MONSTRA" application, you can place animated characters and illustrations in your surroundings through augmented reality in a simple, interactive, and intuitive way.
The application aims to offer a great augmented reality experience. We never save or share with others your data or GPS localisation.

Using our application, you approve that you have read, understood, and agreed to be bound by these Terms.

 

Data collected and form of collection.

We don't collect or store any information like IP address, operating system, device ID, or GPS location when you use our application.
In the installation process, you don't have to share sensitive data. Our application doesn't import, store or use your contacts from the address book, including names, email addresses, and social network identifiers. You are responsible for obtaining permission from your contacts when you choose to provide their contact information to us.
We only ask your name and email to store the content produced by you and never share your data with third parties or use it for advertising purposes. 

 

Camera access.

To use the augmented reality feature, we needed access to the camera from the user device. We only have access to the camera after the user has accepted our explicit request.
The user can't use the application if he doesn't accept that request. We don't have access to the user's cell phone image gallery.

 

Customer support

When you contact our customer support team, we collect and store the contact information you provide (usually your name and email address), information about the activity in our application, and your network identification number. We will also store your communications with the customer service team and all information in those communications to provide support.

 

Sharing your information

We don't share any information about you or your device with third parties. 

 

Background Location Permissions

We don't use background location.

Security measures

We have implemented all necessary security measures to prevent, as far as possible, any alteration or loss of your data or unauthorised access to it.

Suppose we become aware of illegal access to personal data relating to you and correspond to processing for which we are responsible. In that case, we undertake to notify you of the incident as soon as possible if this meets a legal requirement.

Return and refund policy

Since the application is free, there is no return or refund policy.

 

Retention of the right to change offers

We may, without prior notice, change, suspend or limit the services we offer or their resources; We may terminate or suspend, permanently or temporarily, access to the services without notice and liability for any reason or no reason.

 

Intellectual property, copyright and logos

The service and all materials contained or transferred therein, including, without limitation, software, images, texts, graphics, logos, patents, trademarks, service marks, photographs, audio, videos, music, and all copyrights and rights related to them are the exclusive property of Monstra Festival de Lisboa and Unloop. Except as expressly provided in this document, nothing in these Terms shall be considered a license, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works. The intellectual property of this application is protected by the Copyright and Related Rights Code (Decree-Law 63/85, with successive amendments). Except for the violation of moral rights, the criminal offences provided for in the Copyright and Related Rights Code are public (they do not need an express complaint by the injured party). Their participation or complaint to the police authorities is sufficient.

 

Right to suspend user access.

We may permanently or temporarily suspend access to the service without notice or liability for any reason, including if you violate any provision of these Terms or any applicable law or regulation. If you wish, you can stop using the application and request the cancellation of your account at any time.

 

Indemnity

By accepting these terms, you agree to indemnify and/or exempt" MY MONSTRA" from any legal proceedings, losses, liabilities, claims, or expenses (including attorney fees and/or court fees) made against them by any third party due to or arising from, of, or in connection with the use of the application or any of the services offered therein.

 

Limitation of liability

To the maximum extent permitted by applicable law," MY MONSTRA" will under no circumstances be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including, without limitation, damages for lost profits, use of data, or other intangible losses arising out of or related to the use or inability to use the service. To the maximum extent permitted by applicable law," MY MONSTRA" assumes no responsibility for any errors or inaccuracies in content; personal injury, or material damage, of any nature, resulting from accessing or using the application; and any unauthorised access or use of our secure servers and/or any personal information stored on it.

 

Right to change and modify the Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should check the terms periodically. The continued use of the application or associated services after any change constitutes acceptance of the new Terms. If you do not agree with any of these terms or any future version of the terms, do not use or access (or continue to access) our application.

 

Law preference and dispute resolution

These Terms, the rights and remedies provided herein and any claims and disputes related to it and/or the services will be governed, interpreted, and applied in all aspects solely and exclusively by the internal laws of Portugal, without regard to their conflicts of legal principles. Any complaints and disputes will be submitted and decided exclusively by a court of competent jurisdiction of the District of Lisbon.
